KolorYou® - Terms of Use

These Terms of Use are a translation of the original French version, generated by an automated system powered by artificial intelligence. In case of any discrepancies, the French version shall prevail, unless otherwise provided by local laws.

These General Terms of Use (the "GTU") are intended to legally govern the terms and conditions under which the KolorYou® application is made available by DTF medical and to define the conditions of access and use of the application by the "User."

These GTU are accessible from the application when creating an account, and also in the "GTU" section of the User's profile.

Any registration or use of the application implies the user's acceptance of these GTU without reservation or restriction. When registering for the application via the Registration Form, each user expressly accepts these GTU by checking the box preceding the following text: "I acknowledge having read and understood the GTU and I accept them."

If the User does not accept the GTU stipulated in this contract, they must renounce access to the KolorYou® application. KolorYou® reserves the right to unilaterally modify the content of these T&Cs at any time.

Article 2: Purpose and Scope of the Terms and Conditions

KolorYou® is operated in compliance with French law. Use of this application is governed by these general terms and conditions of use (the "Terms and Conditions"). By using KolorYou®, you acknowledge that you have read and accepted these terms and conditions. These terms and conditions may be modified at any time and without notice by the company. DTF medical cannot be held liable in any way for misuse of the service.

Article 3: Description of the KolorYou® Application

KolorYou® is a mobile application that supports mothers in their breastfeeding journey and in their daily life with their baby. It includes several services: an interactive tool to help determine the right nipple size, a logbook to record breastfeeding and baby monitoring data, access to statistics to see your baby's progress, advice articles to support your breastfeeding journey, and a logbook shared with the people of your choice to track your baby's daily life.

Article 4: Access to the KolorYou® Application

KolorYou® provides the User with free access to the various services specified in Article 3 (Description of the KolorYou® Application). The application is accessible free of charge anywhere to any User with internet access. All costs incurred by the User to access the service (telephone, internet connection, etc.) are their responsibility.

Non-member Users do not have access to the KolorYou® application services; they must first register by completing the form with truthful and accurate information regarding their marital status and contact information, including their email address. To access the services, the User must then log in using their username and password.

Any User member may request to unsubscribe by visiting the dedicated page in their personal space. This will be effective within a reasonable timeframe.

KolorYou® shall not be liable for any event due to force majeure resulting in a malfunction of the site or server, and subject to any interruption or modification during maintenance. In such cases, the User agrees not to hold the publisher responsible for any interruption or suspension of service, even without prior notice.

The User may contact the site by email at the publisher's email address provided in Article 1.

Article 5: How the KolorYou® App Works

The app requires iOS 17.0 or later on an iPhone. Its use requires a network connection.

The interactive tool to help determine breast shield size is based on TrueDpeth technology, the operation of which can be viewed here.

The app also works on Android, using a phone that uses this technology. A list of compatible phones can be provided upon request.

Article 6: Hyperlinks

Hyperlinks may be present on the website. Users are informed that clicking on these links will take them away from the KolorYou® website. KolorYou® has no control over the web pages to which these links lead and cannot, under any circumstances, be held responsible for their content.

Article 7: Cookies, Statistics & Images

Use of cookies and analytics complies with applicable local data protection laws, including but not limited to the GDPR (Europe), the CCPA (California), and the PIPEDA (Canada), where applicable.

KolorYou® only uses authentication cookies that last for 24 hours; the app also sends notifications if these were accepted when the account was created. These can be disabled at any time in the phone's application settings.

When using the KolorYou® app and measuring breast shield size, we do not record any images and only use filters on a camera (front or otherwise). No data is stored and no recording is made.

Finally, anonymous statistics on app usage, including, but not limited to: the number of open logs, the number of active and inactive logs, the average lifespan of an active log, and the average creation date of the log relative to the baby's date of birth, are collected for marketing purposes. Users may opt out of such processing in accordance with applicable data protection regulations.

Article 8: Processing of Personal Data

Our company is the sole recipient of the information you provide.

We process personal data in accordance with applicable data protection regulations, including the GDPR (Europe), the CCPA (California), and the PIPEDA (Canada), as applicable.

Article 9: Limitation of Liability

The information contained in KolorYou® is as accurate as possible and is periodically updated, but may nevertheless contain inaccuracies, omissions, or gaps. If you notice a gap, error, or what appears to be a malfunction, please report it by email to the publisher's email address provided in Article 1. DTF medical cannot guarantee or warrant that the application is free of viruses, data-overwriting programs, or other destructive materials. Hyperlinks provided within this application and to other resources on the Internet are provided for convenience and do not incur DTF medical's liability.

Article 10: Intellectual Property

All content of this KolorYou® application, including, but not limited to, graphics, images, text, videos, animations, sounds, logos, gifs, and icons, as well as their formatting, are the exclusive property of the company, with the exception of trademarks, logos, or content belonging to other companies or authors. Any reproduction, distribution, modification, adaptation, retransmission, or publication, even partial, of these various elements is strictly prohibited without the express written consent of DTF medical.

Article 11: Applicable law and competent jurisdiction

These Terms are governed by French law. In the event of a dispute, jurisdiction shall bind with the courts of Saint-Étienne.
